Offer/Order:

An agreement between the buyer and Astart ApS is only considered to have been concluded when Astart has sent the goods or upon written acceptance of the offer. It should be noted that sending an order confirmation to the buyer is not considered acceptance of the buyer's offer, unless this is expressly stated in the order confirmation.

Prices:
All prices are current prices and only valid on the day of ordering. Prices are subject to change. Buyer will be invoiced at the price valid on the day of ordering. All prices are in Danish kroner and are shown excl. 25% VAT.

Payment:
The account information you enter when purchasing goods is sent directly to PBS in encrypted form (SSL), which only you and PBS can read. This means that no one else sees or stores your information. When purchasing with a Dankort or credit card, the amount is deducted from your account as soon as the goods leave www.astart.dk

The following conditions apply to credit purchases:

  1. Payment: The purchase price is due 8 days after delivery of the goods. You will receive an invoice with payment information either with your goods or via email.
  2. Payment methods: We ask that payment be made according to the information provided on the invoice or by bank transfer, possibly via home banking.
  3. Important note about payment methods: Please note that if you choose bank transfer as your payment method, you are not covered by the so-called objection scheme, which only applies to payments by credit card.
  4. Prepayment: Astart reserves the right to require prepayment in certain cases.
  5. Credit rating: All customers who make purchases on credit at Astart will be credit rated on an ongoing basis. The first credit rating is done upon the first order and is carried out via Experian (formerly RKI). Please note that persons under the age of 18 cannot make purchases on credit.
  6. Late payment: If the buyer does not pay on time, Astart has the right to demand interest in accordance with the Act on Interest on Late Payment and reminder fees from the due date.
  7. Retention of Purchase Price: The Buyer is not entitled to retain any part of the purchase price as security for any counterclaims regarding other deliveries. Such retention will be considered a material breach of the agreement.
  8. Card payment: We use the following card payment options: DanKort /ViSA/ViSA Dk/Elektron /MasterCard/Debit /Maestro. There are no hidden fees.

Shipping and Delivery Terms

When you shop at www.astart.dk, you always pay shipping for purchases under 3,000,- kroner ex. VAT / 3,750,- incl. VAT. Shipping prices vary from 120,- and up depending on the weight of the product. We use Danish Freight Forwarders and can deliver throughout Denmark. We can also, by agreement, deliver to other countries in the EU after a prior agreement regarding delivery costs, which the customer must pay. If you as a customer place an order before 9:00 PM, we will send your package the next day, and you will therefore most likely receive your item within 1-3 business days. We would like to point out that some items that are, for example, sent directly from the supplier, may have a longer delivery time than the normal delivery time of 1-3 days.

In the event of delay on the part of Astart, the buyer in a commercial purchase may only invoke remedies for breach of contract if the delay exceeds 30 days after the scheduled delivery date. In this case, the buyer has the option of demanding that the agreement be implemented on a new delivery date or canceling the order. The buyer may not assert other remedies for breach of contract against Astart.

Duty to investigate
In commercial purchases, the buyer is obliged to immediately upon receipt of a product carry out the necessary examinations to determine any defects.

Right of withdrawal

As a consumer, you have a 14-day right of withdrawal when you shop with us. The withdrawal period expires 14 days after the day you receive your item. If you have ordered several different items in one order, but they are delivered individually, the period runs from the day you receive the last item.

The deadline means that you have 14 days from receipt to notify us that you wish to cancel your purchase.

You cannot cancel the purchase by refusing to receive the goods without notifying us at the same time.

The above information also applies when you wish to return goods in connection with repair or complaint. If you regret your purchase, we will of course refund the amount you have paid us. The amount will be returned to the payment card you used or transferred to your bank account when we have received the returned goods and confirmed that they meet the conditions for cancellation. Please note that shipping and postage costs in connection with exercising the right of cancellation are not refundable, and you are responsible for the costs of returning the goods. When you return an item, you must ensure that it is properly packaged. You are responsible for the package and the goods until we have received them, so make sure to keep your postal receipt or track-and-trace number. The item must be returned no later than 14 days after you have notified us that you wish to cancel your purchase. To facilitate the processing of your return, you can enclose a copy of your order confirmation or invoice, and we also encourage the use of our cancellation form, which you can send with the item. Please note that we do not accept return packages sent by cash on delivery. When it comes to the costs of returning goods, we recommend checking prices with different shipping providers, as prices may vary depending on the size, weight and shipping location of the package in Denmark. We would like to inform you that PL reserves the right to the following:

  1. Price changes: Prices are subject to change without notice.
  2. Currency changes: Exchange rates can affect prices.
  3. Changes in taxes: Changes in taxes and duties may affect product prices.
  4. Out of stock items: We cannot guarantee availability of items at all times.
  5. Backorders: In the event of backorders, we will contact you with the options.
  6. Unavailable items: Some products may be temporarily unavailable.
  7. Typos: While we strive for accuracy, typos may occur in product descriptions or prices.
  8. Force majeure: Unforeseen events beyond our control may affect our ability to deliver goods as planned.

Right of complaint

When you shop with us as a consumer, the rules of the Danish Sales Act apply to purchases of goods.
This means that you have the right to complain for 24 months.
If your complaint is justified, it means that you can either have the item repaired, exchanged, your money back or a discount on the price, depending on the specific situation.

You must make a complaint within a “reasonable time” after you have discovered the fault. If you make a complaint within two months after the fault is discovered, the complaint will always be timely.

If the complaint is justified, we will refund your (reasonable) shipping costs. The item must always be returned in proper packaging. Also remember to get a receipt for shipping so that we can refund your shipping costs.

Commercial purchases : The buyer must give written notice of errors/defects directly to Astart without undue delay, however, no later than three days after the defect has been discovered or should have been discovered. The notice must contain a specification of the defect. If the buyer does not notify Astart of a defect within the specified deadlines, the buyer loses his right to make claims in connection with the defect. In the event of a complaint, the buyer is not entitled to return the goods to Astart without prior written acceptance. Any claim for defects, regardless of their nature, must be made no later than 24 months after the date of delivery. If the buyer fails to do so, the buyer cannot subsequently invoke the defect. Astart's liability for errors and defects is always and in any situation limited to, at Astart's discretion, either making a replacement delivery, remedying the defect or notifying the buyer of a reasonably proportionate refusal determined by Astart. The buyer cannot assert other remedies for defects.
Consumer purchases : As a consumer, you have a 24-month right of complaint. For the first 12 months, there is a presumption that a defect was present from the start. For the last 12 months, it is you who must prove that the defect was there from the start. If the complaint is justified, you can either have the product replaced, repaired, or receive a reduction in the price / money back, depending on the specific situation. You must complain within a "reasonable time" (no later than 2 months) after you have discovered the defect. The complaint must be justified, i.e. the defect in the product must not have arisen from, for example, incorrect use of the product or other harmful behavior. If the complaint is justified, we will refund - within reasonable limits - your shipping costs. When returning, please provide as much detail as possible about the problem. Complaint option: A complaint about a product or service can be submitted to Nævnenes Hus, Mediation Team for Consumer Complaints, Toldboden 2, 8800 Viborg via the Complaints Portal for Nævnenes Hus . The mediation team will attempt to resolve the dispute through mediation, and if a solution is not found, you can bring the complaint to the Consumer Complaints Board.
In general, a prerequisite for filing a complaint is that the product or service you wish to complain about has cost at least DKK 1,110 and a maximum of DKK 100,000. For complaints about clothing and shoes, the price must generally be at least DKK 720. The amount limits may be changed. You must pay a fee to have the complaint processed.
The EU Commission's online complaint portal can also be used to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. Complaints can be filed here - http://ec.europa.eu/odr. When filing a complaint, you must provide our email address info@astart.dk

Product responsibility:

For product liability, Astart is solely liable in accordance with the provisions of the Product Liability Act that cannot be waived by agreement. Astart disclaims liability for product damage on any other basis, including - but not limited to - any form of damage to livestock, crops or machinery as a result of using a product purchased from Astart. The amount of product liability may not exceed the coverage of Astart's product liability insurance. The buyer is obliged to notify Astart in writing without undue delay if the buyer becomes aware that damage has occurred caused by the purchased item, that a third party claims that damage has occurred, or that there is a risk that such damage will occur. To the extent that Astart may be held liable to a third party, the buyer is obliged to indemnify Astart to the same extent as Astart's liability is limited in accordance with this clause.

GDPR (Personal Data)

As a customer at Astart, you are registered in our customer database with your personal data. We would therefore like to inform you how data about you is handled and protected by the EU General Data Protection Regulation (GDPR). When Nutrimin processes your information, we focus on anonymity and confidentiality towards you as a customer.

  • We ensure that your data, including relevant personal contact details, is only used in connection with the purposes for which you have been presented.
  • You have the right at any time to be informed about what information we have registered about you.
  • We ensure that you can have your data deleted upon request and have the option to have specific data removed if you wish.
  • The data we have about you is for internal use only and will not be shared with unauthorized parties or used in other contexts without prior agreement with you.

The information is used to identify you as a customer and to provide you with the best possible service, for example by sending you relevant information, registering your purchases and payments, and to provide the services you have requested, such as receiving the newsletter.

Your data will be stored for the period permitted by law and deleted when it is no longer necessary. The period depends on the nature of the information and the reason for storage.
